Please read these terms carefully before using MySalon.me.
Acceptance of terms
By accessing or using MySalon.me (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Platform. These Terms apply to all users, including salon owners, staff members, and clients interacting through the Platform. If you are accepting these Terms on behalf of a business or other legal entity, you represent that you have the authority to bind that entity.
Account registration and security
You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use or security breach. We reserve the right to suspend or terminate accounts that violate these Terms or pose a security risk. You may not use the Platform if you are under 16 years of age.
Service description and availability
MySalon.me provides salon website hosting, online booking, client management, marketing tools, and related services (the "Services"). We reserve the right to modify, suspend, or discontinue features with reasonable notice. We strive to maintain 99.9% platform availability but do not guarantee uninterrupted or error-free service. Planned maintenance will be scheduled during off-peak hours when possible. We are not liable for downtime caused by third-party services, force majeure events, or factors outside our reasonable control.
User obligations and acceptable use
You agree to use the Platform in compliance with all applicable laws and regulations, including data protection laws (GDPR, PIPEDA, Quebec Law 25, CCPA), anti-spam legislation (CASL), and consumer protection laws. You must not: use the Platform for spam, fraud, phishing, or any illegal activity; upload malware, viruses, or harmful code; attempt to access another user's account or data; scrape, crawl, or reproduce Platform content without permission; interfere with the Platform's operation or security; publish content that is defamatory, discriminatory, hateful, or otherwise objectionable. You are responsible for all content you publish on your salon site, including service descriptions, pricing, and images.
Client data and data protection responsibilities
You retain ownership of all client data you collect through the Platform. You represent and warrant that you have obtained all necessary consents and have a lawful basis to collect, process, and store client data through MySalon.me. You are responsible for: providing your clients with a privacy policy that complies with applicable laws; configuring appropriate data retention periods; responding to client data subject access requests; complying with data protection laws relevant to your jurisdiction and client base. We process client data as a data processor on your behalf. Our Data Processing Agreement (DPA) is incorporated by reference and available upon request.
Payment and billing
Paid plans are billed monthly or annually in advance as selected during checkout. All fees are in Canadian dollars (CAD) and are non-refundable except as required by applicable law or as stated in our refund policy. We may change pricing with 30 days written notice. Price changes apply to the next billing cycle. Failure to pay may result in account suspension after a 7-day grace period. Suspended accounts will be inaccessible; data will be retained for 30 days before deletion. You can upgrade, downgrade, or cancel your plan at any time from your account settings.
Deposits and payments through the Platform
If you enable deposit collection through the Platform, deposits are processed by Stripe and held according to Stripe's terms. Deposits are non-refundable unless the appointment is cancelled in accordance with your cancellation policy. You are responsible for communicating your cancellation and refund policies to your clients. We are not a party to the transaction between you and your clients and are not responsible for disputes arising from deposit collection.
Intellectual property
The Platform, including its original content, features, functionality, and underlying technology, is owned by MySalon.me and its licensors and is protected by copyright, trademark, trade secret, and other intellectual property laws. You may not copy, modify, reverse-engineer, decompile, or create derivative works of the Platform. You retain all intellectual property rights to content you create using the Platform, including salon website content and uploaded images. By publishing content on the Platform, you grant us a non-exclusive, royalty-free license to host, store, and display that content solely for the purpose of providing the Services.
Website templates and customisation
Website templates provided through the Platform are licensed, not sold. You may customise templates for your salon website but may not redistribute, resell, or sublicense them. Premium templates may be subject to additional license terms. You are responsible for ensuring your website complies with applicable accessibility standards (e.g., ADA, Quebec accessibility requirements).
Third-party services and integrations
The Platform integrates with third-party services including Stripe (payment processing), Supabase (database and authentication), and Resend (email delivery). Your use of these services is subject to their respective terms of service. We are not responsible for the performance, security, or availability of third-party services. We may add, modify, or remove integrations at our discretion.
Limitation of liability
To the maximum extent permitted by applicable law, MySalon.me and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, business interruption, or reputational harm, arising from or related to your use of the Platform, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim arising from these Terms or the Platform is limited to the amount you have paid us in the 12 months preceding the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
Indemnification
You agree to indemnify, defend, and hold harmless MySalon.me and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: your use of the Platform; your violation of these Terms; your violation of applicable laws; your content or your clients' data; your breach of your data protection obligations.
Termination
Either party may terminate this agreement at any time. You may terminate by deleting your account through the Platform or by contacting us. We may terminate or suspend your account immediately without prior notice if you breach these Terms or if required by law. Upon termination: your access to the Platform will cease; your data will be deleted in accordance with our Privacy Policy; you may request a data export before termination. Provisions regarding intellectual property, limitation of liability, indemnification, and governing law survive termination.
Data retention and export
During your active account, you can export your data at any time through the Platform. Upon termination, we will retain your data for 30 days to allow for data export or account reactivation. After 30 days, data will be permanently deleted from production systems and within 90 days from backups. Client data is deleted according to the retention periods you configured or with your account data.
Governing law and dispute resolution
These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms shall first be attempted to be resolved through informal negotiation. If not resolved within 30 days, disputes shall be finally settled by the courts of Montreal, Quebec. For users in the European Economic Area, nothing in this section deprives you of the protection of mandatory consumer protection laws in your country of residence.
Changes to these terms
We may modify these Terms at any time. Material changes will be communicated via email or through a notice on the Platform at least 30 days before they take effect. Changes that are not material (clarifications, typographical corrections, or changes required by law) may take effect immediately. Your continued use of the Platform after changes take effect constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you may terminate your account.
Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, the remaining provisions will continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it enforceable while reflecting the original intent as closely as possible.
Entire agreement
These Terms, together with our Privacy Policy and Data Processing Agreement, constitute the entire agreement between you and MySalon.me regarding your use of the Platform and supersede all prior agreements and understandings, whether written or oral.
